, the local police chief here confirmed that the gunman was shot dead at 4:48 eastern and officers used lethal force to take him out. he confirmed that the suspect which we identified as james lee entered the building at approximately 1:00 eastern. he carried with him a vest, and also a gun. in addition, we learned a few minutes ago he had two boxes. and two back packs. police here are still work ing under the theory that the boxes and back packs still in the building behind me may contain explosives. we learned that negotiation process or a communication began with the gunman. it went on for a couple of hours and then around 4:00, things were not going well and the tension was ratcheting up. at this point, tactical officers had moved in to the ground forearea of the discover -- ground floor area of the discovery building and they were able to see the gunman james lee with a camera that was now in place. just before 4:48, the suspect pulled out the handgun and pointed it at the hostage. one of the hostages. it was at that point that the police here felt that the hostages were in imminent dange

complete coverage continues with derek valcourt. he is at the scene. he joins us live, via the phone. >>> there is a lot of tension. obviously, a lot of questions for employees of discovery communications who want to know exactly what is going on inside their building. many people were at work around 1:00 this afternoon, when an announcement came over the loud speaker, telling them to make themselves secure in their office. then a massive e-mail went out, at about 1:20, warning them to lock themselves down in their office. if there was some potential danger in the building. another e-mail went out at about 1:52, trying to explain to employees how they would be able to get out. all of the employees were taken up to the top floor of the 7th, 8th, and 9th floor of the building. and then they were all escorted out a fire escape. right now, police are here on the scene. they are briefing the media. i'll have an update for you in just a few moments. >> derek valcourt, reporting live from the phone. the discovery is a very busy section of silver spring. bruce johnson filed this report a sho

to clarify, because you ted -- did tell us there was a pop sound. do you believe that might have been the actual gun shot from police or the subsequent explosion? >> i think it was a gun shot. that is what it sounded like timmie. i was not entirely tuned in, but it caught my attention. others heard it as well. some folks -- it took place outside. almost immediately afterward there was an increase of attention paid by some security folks downtown business district employees who have radios. one of them heard from a colleague that there was a body on the ground. he described it as a person on the ground. >> what appears to me is whether or not any of the hostages came out with this suspect. >> we don't know anything about that. three hostages, but the police chief said there were no injuries. we don't know whether they stayed in or out, but they were not hit by police fire or anything else the hostages are just fine. i am looking past the camera there is an ambulance coming by may. are they directing it down the road? there is a montgomery county ambulance -- now they are holding it. it
? >> you have been watching a briefing by the montgomery county police department, getting us up to date on the discovery communications building on silver spring. thank you for watching fox 5 news at 5 and our continuing coverage of this breaking news. i'm laura evans. >> i'm shawn yancy. let's go over the information. the good news is the three people being held hostage near the entrance of the building are out and all safe and we learned that police shot the suspected gunman and now have him in custody. >> they -- the police are saying that this happened at 450time and that the suspect was shot by police. a device appeared to go off. a pop was audible, according to the chief and there was some smoke. this is a joint operation between the fire department and rescue department. >> right now, police say this is an ongoing, very fluid situation andy that heard that pop. they seeing what are more suspected devices inside the building. originally, it was reported the suspected gunman, when he entered the building, had what appeared to be metallic canisters to the front and back. they heard
buildings and many of us are doing this now that we're in the new reality. >> there is a different vantage point of "discovery" there in the middle of silver springs. people, employees, who evacuated there quickly about 1:00, 130, after all of this started, still some waiting to get back in. we understand that the police have units and making sure there are no other dangerous explosives. this suspect was believed to have brought in boxes and backpacks with him and they're checking those out and probably canvassing the entire building to make sure that it is safe before people go back inside to collect some of their valuable that they need. >> and there is no timetable for this because their job is to make sure the building is safe and not to make sure people can come in, get their purse and keys and get their cars. so this could be something that goes on for some time as well. we heard from the battalion chief from montgomery county, they're literally going to go floor to floor, room to room, to try to identify any potentially dangerous items. and if they come across something, it is their

as the announcement was made. thank you very much for being with us, miss. tell me what you heard and where you were. >> we were at the deck, i was at my desk on the 5th floor. the 5th floor is digital media department. >>shepard: when stuff. the side that is the website of discovery channel. go ahead. >> yes. we heard an announcement there was an "incident," and everyone was to find an office and lock themselves in it but we did not do that because there were, people were just milling and and i was looking out the window and i saw 20 police cars roll up and ñ-what looked like a bomb trucko me and i saw this guy getting all geared up with, like, bullet proof vest and strapping on this gear with like an automatic rifle or machine gun and he walked like under where i was, my window is right above where the lobby is, where this is going down. >>shepard: can you see the lobby from there? >> it is directly below. i cannot see in. and they brought the k-9 units. so, i'm pretty much, i am standing outside and i can see the lobby and all we can see is people milling around inside. i recognize some security
of the explosive devises on him went off as well. >> 9 news now at 7:00 starts right now. please stay with us. >>> a man storms the discovery channel building in silver spring, taking three hostages. >> we heard two gunshots. >> like pop, pop, something like that, but higher pitched kind of. >> reporter: and after a nearly four-hour standoff, tonight that gunman is dead. >>> i'm derek mcginty live at the corner of solesville road and wayne avenue in silver spring, maryland, where it's been a very long day which ended with the shooting of that hostage-taker. a man named james lee walked into the discovery building and perhaps fired a shot. we are waiting for confirmation on that. he took three hostages and held them for four hours and then police opened fire and killed him. delia gonsalves has been here with me much of the afternoon. she gives us more on the details on how it went down. >> it has been a very chaotic day. a lot of questions are still unanswered at this point but we do know thankfully that the three hostages, all men, who were held by the gunman for nearly four hours are now hom
went on there. >> at this time i was not in view of it so i can't comment on that. >> can you tell us how many shooters there were and was it just one shot? >> i'm sorry. what was the question? >> how many shooters were there? snipers were there? >> i don't know yet. that is still under investigation. >> the suspect in this case was arrested as a result of a protest, i guess, at discovery in february of 2008. as a result of that arrest, he was charged with disorderly conduct. he was convicted and serve ad ten-day sentence for disorderly conduct for the protest he did here. he was taking homeless individuals and paying them sum of money to protest with him at the site of this building. as a condition of this probation in 2008, he was ordered to stay at least 500 feet away from the discovery building. his probation ended two weeks ago. >> david, do you expect to be back open for business tomorrow morning? >> we'll be communicating with employees later tonight. it is an active crime scene. >> [ inaudible ]. >> at this time we need to get back to the command post. we thank you very much.
it is in lockdown. the bomb squad is on the scene. so far, no injuries reported. joining us by phone is mr. leonard, more lee's brother if law. are you surprised when you heard the reports today? >> of course i'm surprised. but at the same time, it's heartbreaking. >>neil: what is your connection to mr. lee? >> she my brother-in-law. >>neil: is he still married to your sister? >> no, i'm married to his sister >>neil: the family was concerned about him that it predates the last incident. >> he has been a very unstable and disagreeable personality. >>neil: hang on, the police chief is getting, giving us an update. >> we are the lead agency here. (inaudible) right now we are held by various agencies. it is my understanding that montgomery county police officers are talking with him and that has been continuing for well over an hour closing in on two hours. >> is atf involved? >> i don't know. there are a "small number" of hostages. that has not changed. is there telephone communication? >> i believe by telephone. >> any officers inside? . the three hostages he was holding inside are safe and thank you for joining us tonight on the news edge at 6. >> the news edge at 6 starts right now. >> one bullet from a police sniper. that took the life and that shot rang out an hour ago and some sort of explosive device went off. >> that's right, james lee took hostages, he was waiving a hand bomb and had two pipe bombs. all of the hostages are safe and our team coverage has the latest. >> reporter: one thing we heard interestingly frommion mccarthy there is that that probation period that -- ended two weeks ago and we have a mug shot to show you two years ago, when he was arrested on disorderly conduct charges outside of discovery headquarters and there is his mug shot. he was in the middle of the a weeklong, 12-day protest and basically saying he was trying to get them to save the planet. he was charged and found guilty, acted at his -- as his own attorney and said his goal was to change the programming on the network of broadcasting channels. there he is at a more peaceful protest two years ago and we have youtube video of something t
. they announced in the building, and then they took us all through the garage. >> and do you guys work on staying in a place and security comes to get you. >> yes. >> reporter: some employees learned about the incident when they returned from lunch. >> i was in the atrium and at a meeting at 1:00 and just about that time i was told that there was a gunman in the lobby. >> the effects rippled outward concerning families and people trying to get somewhere. >> first of all my husband works at whole foods so i'm worried if the bomb does go off, he could be effected. and second of all i'm trying to get to see my family in dupont circle and i can't get to see them. i can't leave here. >> why? >> i can't cross the street or leave this side of the street. i'm stuck over here. >> reporter: students at nearby blair high school were released after the incident had begun. a concern to some students. >> i think it was within the radius for -- for some sort of notification. i guess it's like two miles away. so they -- they should be able to at least notify us there might be some sort of transportation issue. >
also revealed to us that -- that he may have pulled out a gun and pointed at one of the hostages and that is what prompted police to shoot him in front of the discovery communications building. we have been following this situation all day long. he is live now in the newsroom. >> you talk about what the police chief just referenced. it people at discovery were familiar with james j. lee. perhaps they had no idea that he would take it to this extent. but as they scoured the internet and read the long list of demands that he had written of discovery, his distaste for discovery certainly had been growing. >> on his myspace page, an ominous looking photo with the caption, i am ready to do something. james j. lee seemed poised for a dramatic act and it would not be his first grade in 2008, commotion outside the discovery channel headquarters after he was handing out fliers that offered $200,000 in property forever could put up with an idea that would -- for a tv show that would help save the planet. >> there is a crazy man handing out money. >> he was arrested for disorderly conduct a
